In consideration of being permitted to participate in the event or activity described above (the “Activity”), the undersigned individual and on behalf of my personal representatives, assigns, heirs and next of kin (referred to as “I” or “me”) hereby voluntarily release, discharge, waive, and relinquish any and all actions for personal injury, property damage, or wrongful death arising at any time against Friends of the Fort Collins Bicycle Program, Inc., doing business as Bike Fort Collins (“BFC”), and its members, administrators, agents, directors, officers, representatives, managers, employees, sub-contractors, volunteers, sponsors, successors, and assigns (collectively with BFC, “Releasees”) that I or any of my property may sustain resulting from or related to my participation in the Activity.
I AM AWARE AND UNDERSTAND THAT PARTICIPATION IN THE ACTIVITY INVOLVES AN INHERENT RISK OF PERSONAL INJURY, PROPERTY DAMAGE, AND EVEN DEATH, AND I HEREBY ELECT TO VOLUNTARILY PARTICIPATE IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE THAT I OR MY PROPERTY MAY SUSTAIN AS A RESULT OF BEING ENGAGED IN THE ACTIVITY, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE, INCLUDING AS A RESULT OF NEGLIGENT RESCUE OPERATIONS. I FURTHER ACKNOWLEDGE THAT I KNOW OF NO MEDICAL REASON WHY I SHOULD NOT PARTICIPATE IN THE ACTIVITY AND THAT EVEN IF I AM INJURED OR SUFFER OTHER LOSSES THAT COULD HAVE BEEN AVOIDED OR PREVENTED BY RELEASESS IN ANY MANNER WHATSOEVER, I WILL HAVE NO LEGAL RECOURSE AGAINST RELEASEES, AND MUST RELY ON MY OWN INSURANCE OR RESOURCES TO COMPENSATE FOR SUCH INJURY OR LOSS.
I will defend, indemnify, and hold harmless BFC and all other Releasees against any and all third party losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers incurred by an indemnified party, arising out or resulting from my participation in the Activity.
I hereby irrevocably grant BFC the right to photograph or videotape me during the Activity and to display, use, or otherwise exploit my likeness, voice, and appearance forever and throughout the world, in all media, whether now known or hereafter devised (including, without limitation, in online webcasts and media, social media, television, motion pictures, films, blogs, newspapers, and magazines) and in all forms, including, without limitation, digitized images, whether for advertising, publicity, or promotional purposes, without compensation, reservation, or limitations. BFC is, however, under no obligation to exercise any rights granted to it by me in this Release.
This Release constitutes the sole and entire agreement of BFC and me with respect to its subject matter and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. BFC may assign this Release and its rights under this Release, in whole or in part, to any third party. Any portion of this Release deemed unlawful or unenforceable by a court of competent jurisdiction is severable and will be stricken without any effect on the enforceability of the Release as a whole to the full extent authorized by applicable law. This Release is binding on and inures to my benefit and the benefit of BFC and each of our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. The laws of Colorado, without giving effect to its conflicts of law principles, govern all matters arising under and relating to this Release. Any claim or cause of action arising under this Release may be brought only in the United States federal court located in Colorado or the state courts located in Larimer County, Colorado, and I hereby irrevocably consent to the exclusive jurisdiction of those courts.
